Twitter asks for Musk to turn over texts from first six months of 2022

Twitter Inc. asks a judge to order Elon Musk to pass on all his text messages from the first six months of 2022, saying the billionaire did not cooperate in exchanging evidence ahead of trial in the battle over his $buyout offer 44 billion.

The social media company filed the public proposed injunction in a court filing Friday in Delaware, which was attached to a sealed petition for sanctions against Musk and his attorneys.

The firm wants Delaware Chancery Judge Kathaleen St.J. McCormick must order Musk to produce all of his text messages from January 1 to July 8, according to court records. Twitter also wants text messages from top Musk assistant Jared Birchall for the same period. Birchall runs Musk's family office and is said to have been heavily involved in setting up funding for the Twitter buyout.

Twitter's lawyers allege that Musk and his lawyers did not act "in good faith" when it came to producing the lyrics as part of the pre-trial information exchange associated with the lawsuit to force him into the deal. of $54.20 per share. The platform and Musk have subpoenaed more than 100 banks, hedge funds and individuals to collect ammunition for an Oct. 17 trial in Wilmington, Delaware.

Musk's attorneys Friday denied any wrongdoing in connection with information exchanges ahead of the trial. They claim that Twitter has launched a campaign to cover up witnesses with detailed information about the number of spam and robot accounts embedded in the platform's customers. Musk has made questions about those accounts the center of arguments he justified for walking away from the deal.

"While Twitter's efforts to hide information and witnesses have been unraveled, they are now trying to distract with this nonsense," Alex Spiro, one of Musk's attorneys, said in an emailed statement.

Under the proposed injunction, Twitter also wants McCormick to order Musk to sit for a statement on his legal team's responses to Twitter's questions about the deal.
